ENERGY PLAN NOW NEEDED FROM 0.1 PJ PRIMARY ENERGY CONSUMPTION UPWARDS
With a recent change in the VLAREM II regulations, companies now need more than in the past to have compliance-certified energy plans. The threshold value for such a plan has now been significantly lowered, from 0.5 to 0.1 PJ of primary energy consumption per year. INGENIUM Group is happy to guide you through the consequences.
The legal framework for companies in Flanders, based on their size and their annual primary energy consumption, has been changed with effect from 7 June 2021 (cf. articles 4.9.1.1 and 4.9.1.2 in VLAREM II). As a result, the threshold for having a compliance-certified energy plan has been lowered to 0.1 PJ primary energy consumption. In other words, any classified installation that consumes more than 0.1 PJ primary energy per year must now have a compliance-certified energy plan. In the past, this was only from an annual consumption of 0.5 PJ primary upwards.
Energy-intensive installations of companies that have joined the energy policy agreements (EPAs) for the anchoring of and for permanent energy efficiency in Flemish energy-intensive industry (both non-ETS and ETS companies) do not fall under this obligation. For them, the EPA energy plan is regarded as a compliant energy plan.
An energy plan contains a list of measures that can reduce the specific energy consumption in the establishment. All measures in this list that have an internal rate of return (IRR) of at least 15 percent after tax must be implemented within no more than three years.
The operator submits its energy plan for certification to the Flemish Energy and Climate Agency (VEKA), which then assesses the energy plan.
